Welcome to Cascade AI. These Terms of Service ("Terms") govern your access to and use of Cascade AI's AI-powered customer support chatbot platform, including our website, applications, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, accessing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services.
If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Account Registration and Security
2.1 Account Creation
To use certain features of our Services, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
2.2 Eligibility
You must be at least 18 years old to use our Services. By using the Services, you represent and warrant that you meet this age requirement.
3. Use of Services
3.1 License Grant
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal business purposes.
3.2 Acceptable Use
You agree not to:
- Use the Services for any illegal or unauthorized purpose
- Violate any laws, regulations, or third-party rights
- Transmit malware, viruses, or any malicious code
- Attempt to gain unauthorized access to our systems or networks
- Interfere with or disrupt the integrity or performance of the Services
- Reverse engineer, decompile, or disassemble any part of the Services
- Use the Services to harass, abuse, or harm others
- Scrape, crawl, or use automated tools to access the Services without permission
- Resell, redistribute, or sublicense the Services without authorization
3.3 Content Guidelines
When using our chatbot platform, you must not upload or transmit content that:
- Infringes on intellectual property rights
- Contains hate speech, discrimination, or promotes violence
- Includes personal information of others without consent
- Contains sexually explicit or obscene material
- Violates any applicable laws or regulations
4. Subscription Plans and Billing
4.1 Subscription Plans
We offer various subscription plans with different features and usage limits. Plan details and pricing are available on our pricing page. We reserve the right to modify our plans and pricing with reasonable notice.
4.2 Billing and Payment
- Subscriptions are billed in advance on a recurring basis (monthly or annually)
- You authorize us to charge your payment method for all fees
- Fees are non-refundable except as required by law or specified in these Terms
- You are responsible for providing valid payment information and keeping it updated
- Failure to pay may result in service suspension or termination
4.3 Cancellation and Refunds
You may cancel your subscription at any time. Cancellations take effect at the end of your current billing period. We do not provide refunds for partial subscription periods, except as required by law or at our sole discretion.
5. Data and Privacy
5.1 Your Data
You retain all rights to the data you upload to the Services ("Customer Data"). By uploading Customer Data, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your data solely to provide and improve the Services.
5.2 Data Responsibility
You are solely responsible for the accuracy, quality, and legality of your Customer Data. You represent and warrant that you have all necessary rights to upload and use the data with our Services.
5.3 Privacy
Our Privacy Policy explains how we collect, use, and protect your information. By using the Services, you consent to our data practices as described in the Privacy Policy.
6. Intellectual Property Rights
6.1 Our Rights
The Services, including all software, text, graphics, logos, and other content (excluding Customer Data), are owned by Cascade AI and are protected by copyright, trademark, and other intellectual property laws.
6.2 Feedback
If you provide feedback, suggestions, or ideas about the Services, we may use them without any obligation to you, including for product improvements and marketing purposes.
7. AI Model Training
We may use anonymized and aggregated conversation data to train and improve our AI models. This helps us enhance the accuracy and performance of our chatbot platform for all users.
Enterprise plan customers can opt out of having their data used for AI model training by contacting our support team. Personal identifying information is always removed before any training process.
8. Service Availability and Support
8.1 Service Level
We strive to maintain high availability of our Services, but we do not guarantee uninterrupted or error-free operation. We may perform maintenance that temporarily affects service availability.
8.2 Support
Support availability varies by subscription plan. Enterprise customers receive priority support with faster response times.
9. Termination
9.1 By You
You may terminate your account at any time by following the cancellation process in your account settings or contacting support.
9.2 By Us
We may suspend or terminate your access to the Services if:
- You violate these Terms
- Your account has unpaid fees
- We are required to do so by law
- We discontinue the Services (with reasonable notice)
9.3 Effect of Termination
Upon termination, your right to use the Services will cease immediately. We will delete your Customer Data within 90 days unless legally required to retain it. You remain responsible for fees incurred prior to termination.
10. Warranties and Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Warranties that the Services will be uninterrupted, error-free, or secure
- Warranties regarding the accuracy or reliability of AI-generated responses
You acknowledge that AI systems may produce inaccurate, incomplete, or inappropriate responses. You are responsible for reviewing and verifying all AI-generated content before use.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASCADE AI SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Damages resulting from use or inability to use the Services
- Damages from unauthorized access to your data or account
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless Cascade AI from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.
13. Changes to These Terms
We may modify these Terms at any time. We will notify you of material changes via email or through the Services. Your continued use of the Services after such changes constitutes acceptance of the modified Terms.
14. Governing Law and Dispute Resolution
14.1 Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
14.2 Dispute Resolution
Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in San Francisco, California, except that either party may seek injunctive relief in court to protect intellectual property rights.
15. General Provisions
- Severability: If any provision is found unenforceable, the remaining provisions continue in effect
- Waiver: Our failure to enforce any right or provision does not constitute a waiver
- Assignment: You may not assign these Terms without our consent; we may assign them freely
- Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Cascade AI
- No Agency: No agency, partnership, or employment relationship is created by these Terms
